Summary

Investor-owned electric utilities; fuel factor proceedings; requirements. Requires that in any fuel factor proceeding conducted with the State Corporation Commission under current law, each investor-owned electric utility shall provide specific information regarding coal-fueled or oil-fueled electric generating units and requires the Commission to make determinations about reasonableness and prudence for the purposes of cost recovery based on such specific information.

Stronger oversight of utility fuel charges

The law requires investor-owned utilities to give more detail in their first fuel factor filing. They must list each hour any coal- or oil-fired unit was set as must-run. They must show that unit’s marginal operating cost for each hour and explain each must-run reason. They must also report the energy market clearing price set by the regional transmission entity for each hour. The State Corporation Commission reviews each must-run decision and denies cost recovery it finds unreasonable or imprudent.
