Summary

School board policies; unpaid educational leave for certain employee association officers; purchase of service credit. Requires each school board to adopt a policy to approve unpaid educational leave for school board employees who are state employee association executive officers and for up to two school board employees who are local employee association officers for a maximum of four years per officer. The bill permits employee association officers approved for such leave to purchase service credit with the Virginia Retirement System for such period of leave.

Virginia Retirement System members can buy credit for employer‑approved educational leave (including the new unpaid association leave), up to four years of prior active‑duty military service if not dishonorably discharged, time not reported while on workers’ compensation, and service lost after a prior withdrawal by repaying with interest. On your retirement date, you can use any employer payout for unused sick leave to buy credit. If you left a covered job for military duty, returned within one year, had no dishonorable discharge, and meet Board rules, you get that military time credited for free.

Costs and deadlines to buy retirement credit

If you buy service credit within 24 months after hire or the end of leave, you pay the approximate normal cost; after that, you pay the actuarial equivalent. You can pay by lump sum or payroll deduction; you get credit only for what you paid, and any extra deductions must be refunded. Your employer may choose to pay your required member contributions for a purchase. If payroll errors caused missed contributions, the last three years are bought at the rates in effect then, and earlier years must be paid by the employer at actuarial cost. Certain purchased service under this section has a four‑year cap.

New leave and pay rules for school staff

School boards must allow unpaid leave if an employee has a debilitating or life‑threatening illness or injury, with no minimum time on the job. Boards must also approve up to four years of unpaid educational leave for state employee association executive officers and for up to two local association officers; these officers can buy retirement credit for that leave. All school employees are paid monthly, semimonthly, or biweekly, and if students start before August 15, contract staff are paid within their first month of work. Mileage or travel pay cannot be higher than the state travel rate and must be the same for board members and employees.
