Limits on trick-or-treat age rules

Localities cannot set trick-or-treat age limits that are stricter than their general loitering or curfew rules. This protects access for families under the same rules that apply to other public activities. This limit only takes effect if the General Assembly reenacts the act in 2027.

Local curfews and loitering rules for minors

Localities can ban loitering in public places, even on private property open to the public. They can set curfews for minors who are not with a parent, such as 10:00 p.m. to 6:00 a.m. Public libraries count as public places under these rules. Minors who break these rules go through juvenile court under existing state law. Localities may set penalties at places of amusement, but not above a Class 3 misdemeanor. None of these rules start unless the General Assembly reenacts this act in 2027.
