Summary

Regulation of contractors; solar installation companies; sale, lease, or power purchase of solar energy systems; civil penalty. Authorizes the Board for Contractors (the Board) to require specific contract provisions and disclosures relating to the sale, lease, or power purchase agreement for a residential solar energy system, as defined in the bill. The bill requires a sale, lease, or power purchase agreement for a residential solar energy system to have a written contract that includes specific provisions related to the solar installation company, system design and performance or production guarantees, and information related to invoices and payments. The bill includes several mandatory disclosures to be included with a sale, lease, or power purchase agreement for a residential solar energy system. Under the bill, a willful violation of such requirements shall be subject to a civil penalty of no more than $2,500 per violation. The bill also directs the Board to adopt regulations and update existing regulations to implement the provisions of the bill by January 1, 2027. The remaining provisions of the bill have a delayed effective date of January 1, 2027. This bill is identical to SB 823.

Fines for breaking solar contract rules

Beginning January 1, 2027, installers who willfully break the solar contract and disclosure rules can be fined up to $2,500 per violation. Continued violations after a confirmed notice count as evidence of willfulness. Money from fines goes to the Low‑to‑Moderate Income Solar Loan and Rebate Fund.

Clearer home solar contracts and disclosures

Beginning January 1, 2027, any home solar sale, lease, or power‑purchase deal must use a clear, written contract (10‑point type). It must list installer or owner contacts and licenses, payments and fees, and key design assumptions. For sales, the contract must show the total cost up front. No extra work or price change can happen without a signed change order. You can cancel within five business days with no penalty. You do not owe payments to a third‑party owner until the system is installed, approved to operate, interconnected, and working. Disclosures also cover maintenance, warranties, removal costs for leases, renewable‑credit ownership, interconnection duties, and transfer or financing impacts.

Written contracts for home projects

Beginning January 1, 2027, Class A, B, and C residential contractors must use legible written contracts. Contracts must describe the work, give a fixed price or estimate, list any payment schedule and down payment, and give estimated start and finish dates. They must also show the contractor’s contact, license, and class. Subcontractors and routine maintenance or service contracts are excluded.

Training and worker classification for contractors

Beginning January 1, 2027, anyone seeking an initial contractor license must finish a Board‑approved basic business course, up to eight hours. Contractors must correctly classify workers as employees or independent contractors. The Board can sanction intentional misclassification.

Contractor Board structure and 2027 rules

Virginia creates a 16‑member Board for Contractors with four‑year terms. It meets at least once a year; nine members make a quorum. The Board must adopt rules and a standard solar‑deal disclosure form by January 1, 2027, and give guidance on handling unknown structural or repair costs found after signing or during install. The first enactment of the act takes effect January 1, 2027.
