Health insurance; claims experience information. Provides that provisions requiring insurers to provide policyholders with certain claims experience information apply to all employee welfare benefit plans and include pharmacy benefits claims.

Large employers get free claims data

If your group plan averaged at least 100 covered people last year, you can request your full claims record. It includes pharmacy benefits costs. The record covers claims since the policy was issued or since the last renewal. Ask at least 30 days before premiums or terms may change to get the full record. With a written request at least 45 days before, the insurer must respond within 20 business days with a 24‑month summary, total enrollment by membership type, and a count of members with $100,000+ in combined claims for the last 12 months (and the prior 12 months if not already given), plus whether they still enroll. You may agree by contract to a lower dollar threshold for that list. Insurers, TPAs, and PBMs cannot charge you for this data, and they must protect personal or privileged information.

When these disclosure rules apply

For group accident and sickness policies, these rules apply to policies delivered or changed on or after July 1, 2003. For health care plan contracts, they apply on or after January 1, 2005. They also apply to employee welfare benefit plans delivered or changed on or after January 1, 2027. However, this law does not take effect unless the General Assembly reenacts it in the 2027 session.
