Summary

Vehicle weight limits; violations; owner of commercial motor vehicle hauling coal. Assigns liability for violations of certain vehicle weight limits for commercial motor vehicles hauling coal to the owner of the vehicle in violation of such weight limits. Existing law authorizes such liability to be assigned to the owner, operator, or both.

Overweight truck violations: fees and liability

If you violate weight limits or permit terms, you pay a $25 civil penalty and a $20 processing fee per violation. You also pay any liquidated damages and weighing fees. If the vehicle could get a permit but ran without one, the owner or lessee is charged. These charges are on top of any civil liability for damage to a highway or bridge caused by the overweight load. The DMV collects these amounts. Civil penalties go to the Literary Fund, and processing fees go to a DMV special fund.
