Summary

TNC partners; requirements and background screening. Changes the requirements for background screening of a transportation network company (TNC) partner to specify that background checks are not to be limited to a specific period of time, except as required by law, and shall include all addresses at which such TNC partner has resided since the age of 18. The bill also changes the entity by which persons conducting background checks for TNC partners are required to be accredited to the Professional Background Screening Association.

Stricter background and eligibility rules for app-based drivers

Companies must confirm you are at least 21 and have a valid license before you can drive. They must run a national criminal background check before onboarding and at least every two years, including multi-state searches and sex‑offender registries, using an accredited screener. The check must cover all addresses since age 18 and is not time‑limited by the company. They must also get your driving record before onboarding and at least once a year. You are barred if you are on a sex‑offender registry or ever had a violent felony; for certain felonies or DUI‑related offenses in the last 7 years; and, in the last 3 years, for three or more moving violations, eluding, reckless driving, driving while suspended, or refusing a chemical test.

Clear insurance and lien notices to drivers

Companies must give you written details about insurance they provide while you use the app: liability, any physical damage coverage, and uninsured/underinsured motorist limits. They must also tell you that your own auto policy may not cover you while driving on the platform. If your car has a loan or lien, they must warn you to notify the lienholder because ridesharing may violate your loan terms.

Zero‑tolerance and reporting rules for app-based drivers

Each company must keep a zero‑tolerance drug and alcohol policy and post it in the app and on its website. If you are an authorized driver, you must promptly tell every company that approved you about events that may disqualify you, such as license suspension, insurance or registration changes, moving violations, arrests, pleas, or convictions.
