Summary

Appointment of administrator; property damage claims. Allows for the appointment of an administrator in any case in which it is represented that a civil action for property damage arising within the Commonwealth is contemplated against or on behalf of the estate or the beneficiaries of the estate of a resident or nonresident of the Commonwealth who has died within or outside the Commonwealth. Under current law, such appointments are limited to civil actions for personal injury and wrongful death. This bill is a recommendation of the Boyd-Graves Conference.

Court clerk appoints estate litigation administrator

A Virginia circuit court clerk can appoint an administrator 60 days after a death if no executor has been named. This administrator can sue or defend personal injury, wrongful death, or property damage claims for the estate; property damage must have happened in Virginia. The appointment is only for handling these lawsuits, not full probate. A fiduciary named in another state can qualify here, and that out-of-state appointment does not block a resident or nonresident from qualifying to bring wrongful death or personal injury cases in Virginia. The court may also name a resident and a nonresident as coadministrators.
