Special election to fill certain vacancies in the General Assembly; deadline for parties to nominate. Requires parties to nominate candidates for any special election to fill a vacancy in the General Assembly occurring between December 10 and March 1 within seven days of any writ of election or order calling such special election.

New deadlines for nonprimary party nominations

The law sets fixed deadlines when parties pick candidates without a primary. For November general elections, nominations are due by 7:00 p.m. on the third Tuesday in June. For May general elections, nominations are due by 7:00 p.m. on the first Tuesday in March. If a special election is held with a November general election, parties nominate at least 81 days before. If the vacancy is filled at the second November after it occurs, the deadline is 7:00 p.m. on the third Tuesday in June before that election. If a special election is held with a May general election, nominations are due by 7:00 p.m. on the first Tuesday in March. For a stand-alone special election, parties must nominate at least 60 days before. If the writ or order sets the election in less than 60 days, parties have five days from the writ or order. If a General Assembly vacancy occurs between December 10 and March 1, parties have seven days from the writ or order. For all general elections, nonprimary nominations may happen only in the 47 days before that office’s primary date. This 47-day rule does not apply to special elections or to nominations under § 24.2-539.
