Farm and temp foreign workers excluded from minimum wage

Beginning January 1, 2027, the law excludes farm laborers or farm employees and temporary foreign workers covered by 20 C.F.R. Part 655 from this minimum wage rule. These workers are not treated as "employees" under this article. Their employers do not have to follow this law’s minimum wage protections for them. Check whether your job falls into one of these groups.

New rules for tipped workers and pay

Beginning January 1, 2027, you are a tipped employee if you get more than $30 in tips in a month. Employers can decide how much of your tips count toward your wage. If you believe that amount is too high, you must show clear and convincing proof that you received less. If a job cannot legally ask for tips, the employer cannot classify you as a tipped employee.
