Summary

Public institutions of higher education; disciplinary immunity for certain individuals who make reports; Virginia Military Institute. Removes the authority granted to Virginia Military Institute to include in its sexual violence policy, code, rules, or set of standards a provision stipulating that in the event that a cadet discloses personal consumption of drugs or alcohol in conjunction with a good faith report of an act of sexual violence and the superintendent of Virginia Military Institute determines that such cadet's personal consumption of drugs or alcohol constitutes a threat to the cadet's well-being or the well-being of others, the superintendent may require such cadet to attend drug or substance use disorder counseling.

Colleges must certify sexual violence policies yearly

Every year by October 31, the community college system, Richard Bland College, all public four-year colleges, and all nonprofit private colleges in Virginia must review and, if needed, update their sexual violence policy and certify this to the state Council. The Council and the Department of Criminal Justice Services set the certification rules and can ask for information. By November 30 each year, the Council reports which schools certified to the Secretary of Education. This creates regular checks to keep campus policies current and clearer for students.

Students get immunity when reporting sexual assault

All public and nonprofit private colleges in Virginia must give immunity from school discipline for curfew violations and personal drug or alcohol use when a student makes a good‑faith report of sexual violence and discloses those violations. This also applies at the Virginia Military Institute (VMI). At VMI, the superintendent can require a cadet to attend drug or substance use disorder counseling if the disclosed use is found to be a threat to the cadet or others. Cadets still keep immunity from discipline for the disclosed curfew or personal use violations.
