Summary

Live streaming while driving; prohibited; penalty. Prohibits any person, while driving a moving motor vehicle on the highways in the Commonwealth, from (i) initiating, participating in, or interacting with any live stream, as that term is defined in the bill, and (ii) manipulating any electronic device to enable or maintain the functions of a live stream on or with such electronic device. The bill establishes penalties for violations, in addition to any other penalties available under current law, including periods of license suspension and a fine of not more than $500 if a person who commits such a violation is involved in an accident at the time of such violation.

Limits on police stops and searches

Police cannot pull you over just for this. Any evidence from such a stop cannot be used in court. This law does not allow warrantless searches of phones or devices. Dashcams and fleet cameras that record but do not stream live are allowed.

No live streaming while driving

You cannot start, join, or keep a live stream while driving a moving vehicle on Virginia highways. You also cannot tap a device to enable or maintain a live stream. This rule does not cover apps made mainly for calls or video meetings. You may live-stream to report an emergency or a crime.

Penalties for live-streaming while driving

First conviction: fine up to $500. Second conviction: 30-day license suspension. You must surrender your license. Third or later: 90-day suspension. You must surrender your license. The court may give a restricted license for limited travel needs allowed by law. If an accident happened, the court may add another fine up to $500. If you lack a license or live out of state, the court can bar you from driving in Virginia for that time.
