Summary

Medicare supplement policies; regulations establishing minimum standards; work group; report. Amends provisions related to the State Corporation Commission's issuance of regulations to establish minimum standards regarding Medicare supplement policies to include minimum standards for the disclosure of methodology used in coverage decisions. The bill directs the Bureau of Insurance to convene a work group to review and make recommendations related to minimum standards regarding Medicare supplement policies, implementation of risk adjustment mechanisms, ways to eliminate waste and abuse from overpayments, methodologies used in coverage decisions, ways to improve care under such policies, and the effectiveness and utilization of existing consumer protections related to Medicare supplement policies and to submit a report of its findings and recommendations by December 1, 2026.

Stronger rules for Medigap insurers

The State Corporation Commission can set minimum rules for Medicare supplement (Medigap) policies. The rules cover how claims are processed and paid. They also cover marketing, agent pay, loss‑ratio refunds or credits, Medicare Select plans, and insurer reporting. Regulations can require insurers to disclose how they make coverage decisions.

Work group to improve Medigap and Advantage

The Bureau of Insurance convenes a work group on Medicare Advantage and Medigap costs and problems. The group includes consumers and at least two Virginia Medigap policyholders or recent applicants. It reviews claims standards, risk adjustment and stabilization pools, cutting waste and overpayments, coverage decision methods and insurer disclosures, care quality and disparities, and consumer protections like the 60‑day birthday open enrollment and guaranteed‑issue rules. It reports findings and recommendations by December 1, 2026.

Limits on expanding Medigap rules

The Commission may expand Medigap regulations only as needed to keep federal approval. This limits how far Virginia can add new consumer protections or requirements beyond what federal rules require.
