Summary

Continuing care providers; quarterly meeting requirements. Amends the quarterly meeting requirements for continuing care facilities to provide that at least two of such meetings per year shall be open to all residents and that certain individuals shall participate in at least two of such meetings per year. The bill also requires, if requested by the resident council or a majority of the independent living residents of a continuing care facility, the provider to include as a participant in the meetings of its board of directors or other governing body a resident representative elected by a majority of such residents, who shall participate in a non-voting, advisory capacity. This bill is identical to SB 358.

Stronger voice for continuing care residents

The law protects your right to form or join a residents’ group and to file complaints, without retaliation. The provider must give that group copies of anything it submits to the Commission. The board or governing body meets with residents at least every three months, led by a representative who is not the executive director or a facility employee. Residents get at least seven days’ notice, and at least two meetings a year are open to all. At least two meetings a year include an in-person non‑employee board member and the CEO or equivalent; at least one of those is open to all. If the resident council, or a majority of independent living residents, asks, an elected resident adviser (non‑voting) joins board meetings; the board may still hold closed executive sessions without the adviser as allowed by law.
