Summary

Social work; licensure; criminal background check. Requires applicants for licensure as a baccalaureate social worker, master's social worker, or clinical social worker to provide fingerprints and personal identifying information for a criminal background check, directs the Central Criminal Records Exchange to disseminate criminal history record information obtained to the Board of Social Work, and establishes the process by which an applicant may obtain his criminal history record in the event that such applicant disputes the criminal history information on which a denial of licensure privilege is based. The bill specifies that no criminal history record information obtained from a national criminal history record check conducted for employment or licensing purposes pursuant to federal law shall only be further disseminated to a federal, state, or local government agency or entity. The bill also specifies that any state or local government agency or entity that receives such record information shall not disseminate such information to any private person or entity. The bill also requires the Department of State Police (the Department) to convene a work group to review potential issues and concerns regarding the dissemination of criminal history record information. The bill requires the Department to report its findings and recommendations to the Governor and the General Assembly by December 1, 2026. The bill has a partial delayed effective date of July 1, 2027.

Stronger privacy for criminal records

Beginning July 1, 2027, only the people and agencies named in law can get criminal-history records. Non‑criminal‑justice groups may use them only for the stated purpose and may not share them again, except in narrow cases set in law. Agencies must check the Central Criminal Records Exchange for the latest case result before sharing, unless time is critical. Arrests older than one year with no recorded disposition and no pending prosecution cannot be shared outside criminal‑justice agencies. FBI national check results for jobs or licensing can be shared only with government agencies and cannot go to private parties. Prosecutors must give records for court discovery, but those copies cannot be shared further.

Narrower checks for care jobs

Beginning July 1, 2027, nursing homes, hospitals, and home care groups get only the specific convictions listed in state health‑care statutes. Licensed assisted living facilities and adult day centers get only the conviction list set for those facilities. Public agencies checking adult foster care or home‑based service providers get only the convictions on the state’s barrier‑crime list for that purpose. These groups do not receive broader criminal‑history details.

Conviction records for you and employers

Beginning July 1, 2027, an employer can ask the Central Criminal Records Exchange for your conviction record if you first consent in writing and show photo ID. The employer must send a written request and pay the fee. If no convictions are found, the Exchange gives a certificate. You can also get your own conviction record by sending a sworn written request and signing under oath, and you may share your own record. If none exists, you get a certificate for a fee.

Fingerprint checks for social workers

Applicants for a social work license must submit fingerprints for state and FBI checks. The Central Criminal Records Exchange sends the results to the licensing board. You pay the fingerprinting and background-check fees. If you are denied because of criminal-history data and you dispute it, the Exchange must give you the steps to request your FBI and state records.
