Summary

Division of Consumer Counsel; duties; artificial intelligence fraud and abuse. Expands the duties of the Division of Consumer Counsel to include establishing mechanisms for receiving and investigating complaints by the Commonwealth's consumers involving emerging technologies, including referring appropriate complaints to the federal, state, and local departments or agencies charged with the enforcement of applicable consumer laws.

Consumer hotline, complaint help, and education

The Division runs a statewide, toll-free hotline for consumer questions and complaints. It publicizes the line on TV, radio, newspapers, and online, and improves Internet contact. It sets up programs to help resolve complaints, using staff, volunteers, schools, and local consumer offices. It serves as a central clearinghouse and can refer cases to the right enforcement agency. It keeps records of complaints and outcomes open to the public. It keeps business secrets and customer names confidential unless needed for law enforcement. It also takes and investigates complaints about emerging technologies and can refer them to other agencies.

New state consumer advocate office

The law creates a Division of Consumer Counsel inside the Virginia Department of Law. It speaks for consumers before state commissions and agencies, including the State Corporation Commission. It investigates matters tied to those cases and studies how to better enforce consumer laws. It recommends needed laws to the Governor and General Assembly. The Division works with other agencies but does not change their legal duties. The Attorney General hires the staff and sets pay within the office’s budget.

State help for towing complaints

The Division can take and investigate consumer complaints about towing companies, tow truck operators, and drivers. It covers violations of Virginia towing laws listed in the act. It can also send towing complaints to local enforcement officials.
