Summary

Unauthorized use of voice or likeness; punitive damages; statute of limitations. Expands the existing ability for any person to maintain a suit in equity, including the accompanying remedies available and statute of limitations, for the unauthorized use of his name, portrait, or picture for advertising purposes or for the purposes of trade to include the unauthorized use of his voice or likeness. This bill is identical to SB 753.

The law requires written consent before using a person's name, picture, voice, or likeness in ads or for trade. If someone uses your identity without consent, you can sue to stop it and get damages. For a minor, a parent or guardian must give consent. For a deceased person, the surviving consort, or if none, the next of kin must consent. A jury may also award punitive damages for knowing misuse.

20-year deadline for deceased likeness claims

For claims about a deceased person’s name, picture, voice, or likeness, you must start suit within 20 years after death. After 20 years, the law bars the case.
