Summary

Zoning; manufactured housing. Amends existing provisions that require localities to permit manufactured homes in areas zoned for agriculture by expanding such requirement to all zoning districts where site-built housing is allowed, with certain conditions. The bill provides that localities shall not adopt or enforce any zoning, land-use, or development regulation that treats manufactured homes differently or more restrictively than a single-family site-built dwelling allowed in the same zoning district. The bill also removes the authority of localities without a zoning ordinance to designate the areas within the locality in which manufactured homes may be located. This bill incorporates HB 418 and HB 801 and is identical to SB 346.

Easier to place manufactured homes

Local zoning must allow manufactured homes in agricultural or similar districts where site-built homes are allowed. In other similar districts, you can place a manufactured home on an individual lot if it is on a permanent foundation, is converted to real property under Virginia law, and gets a certificate of occupancy within five years of its manufacture date. Local rules must use development standards equal to those for site-built single-family homes. Local governments cannot treat manufactured homes more strictly than site-built homes. Uniform residential rules are allowed, but they cannot exclude homes that meet Virginia safety standards.

Localities can zone for manufactured homes

Your local government can pass an ordinance to name where manufactured homes and parks can go, even without a full zoning code. It can use state subdivision rules to set how homes and parks are located and run. It can also apply these rules to parks or parts of parks that are licensed as campgrounds. This can create more places that allow manufactured housing in your area.

State law controls, covenants still apply

If a local rule conflicts with state manufactured-housing law, the state law controls. Local historic-preservation powers still apply and can limit where homes go in protected areas. Private restrictive covenants on your deed or in your neighborhood still bind you, even if zoning allows a manufactured home.
