Summary

Forensic Science Board; Scientific Advisory Committee; members; service after expiration of term. Provides that a member of the Forensic Science Board and a member of the Scientific Advisory Committee appointed by the Governor shall serve after expiration of his term until his successor is appointed. The bill also removes the requirement that meetings of the Scientific Advisory Committee take place in the City of Richmond. The bill contains technical amendments. The bill also contains an emergency clause.

Forensic Science Board members and meetings

The law sets a 15-member Forensic Science Board in the executive branch. Members include top justice and lab officials or their designees, two members picked by the Scientific Advisory Committee chair, and three citizens the Governor appoints (law enforcement, a prosecutor, and a defense lawyer with forensic expertise). Legislators serve while in office; Governor appointees serve four-year terms and stay until replaced, but must still hold the qualifying job. Serving on the Board does not make a member give up any other public job. The Board elects a chair and vice chair, needs a majority to act, and reimburses reasonable expenses; legislative and citizen members get pay as state law provides. The Board meets at least four times a year; the chair sets meetings, and any five members can request one in writing.

Law takes effect immediately on passage

An emergency clause makes this law effective upon passage. The Board and Committee rules start right away.

Scientific Advisory Committee setup and pay

The law creates a 13-member Scientific Advisory Committee. The Department’s Director is a member, and the Governor appoints 12 experts across key forensic fields, including chemistry, biology, genetics, toxicology, trace evidence, and lab leaders. Initial terms are staggered at 1, 2, or 4 years; after that, terms are four years. Members serve until a successor is named, and the Governor fills vacancies. Members are reimbursed for reasonable expenses and paid as state law allows. The Committee meets at least twice a year in Richmond, elects a chair from the Governor’s appointees, and gets staff support from the Department of Forensic Science.
