Summary

Conveyance of property; Leesylvania State Park. Authorizes the Department of Conservation and Recreation to convey property to and acquire property from the Newport Estates Homeowners Association, Inc. at Leesylvania State Park. The conveyances will provide a permanent access from Neabsco Road in Prince William County to property owned by the Association that is otherwise inaccessible to allow the Association to complete repairs and restoration to a slope failure due to poor soils on the Association's neighborhood open space property while ensuring that the Department retains property of recreational utility at Leesylvania State Park.

Land swap with Newport Estates HOA

The law lets the Department of Conservation and Recreation transfer up to five acres from a named parcel to Newport Estates HOA. In return, the HOA must give the state land next to Leesylvania State Park that has equal recreation value and grant an open-space easement on other HOA land in an amount the Department finds sufficient. No cash changes hands between the HOA and the Commonwealth. The goal is to secure permanent access from Neabsco Road and allow slope repair and restoration on HOA open space while keeping park land useful. The exchange must follow state approvals: a recommendation from the Department of General Services, the Governor’s written approval (or the Secretary of Administration if delegated), and the Attorney General’s approval of the legal documents.
