Summary

Credit for time spent in confinement while awaiting trial; extradition or fugitive warrant. Provides that if any person is extradited from another state pursuant to (i) an extradition warrant from the Commonwealth or (ii) a fugitive warrant issued from the state where such person is detained and such person is subsequently sentenced to a term of confinement in a correctional facility in the Commonwealth for an offense from the same act as the violation for which the extradition warrant or fugitive warrant was authorized, such person shall have deducted from any such term all time actually spent in confinement awaiting extradition from such other state, provided that he was solely held on the extradition warrant or fugitive warrant and not on any other offense that he allegedly committed in such other state. This bill is a recommendation of the Virginia Criminal Justice Conference.

Court must record and honor credit

When the court enters the final order, it must say you get credit for qualifying days. If the order leaves it out, you still get those days credited. This credit is on top of any good‑conduct or earned sentence credits you receive.

Pretrial and extradition time counts

Virginia subtracts days you actually spent locked up before trial from your sentence. This includes time in jail or a local facility while waiting for trial or an appeal, and time in a state hospital for exams or treatment. It also counts juvenile detention if that case later leads to an adult sentence. Time on separate charges that were dismissed still counts if they came from the same act. Days you were held in another state only on a Virginia extradition or fugitive warrant for the same act also count.

No credit for bail or escape

You do not get credit for time when you were not actually confined. Time out on bail does not count. No credit is given for time during an escape or when absent without leave from juvenile detention.
