Summary

Fertilizer and lime permit requirements. Amends the provisions governing the permit requirements for bulk lime materials to add a distributor who holds a valid license to distribute a regulated product, as defined in the bill, to the list of people who can sell bulk liming material. The bill also removes duplicative language relating to (i) when a permit expires, (ii) the cost of obtaining a permit, and (iii) the authority of the Commissioner of Agriculture and Consumer Services to issue written notices and collect fees for failing to obtain a permit.

Enforcement and buyer guarantees for bulk lime

If a contractor does not get the required permit after the grace period, the Commissioner can order a stop of sale, use, removal, or seizure of the bulk lime they sell. The order stays in place until the contractor gets the permit. Authorized sellers must also guarantee to buyers that the contractor followed all rules for the sale and delivery.

Rules, fees, and deadlines for bulk lime sellers

It is unlawful to sell bulk liming material unless you are registered or licensed, hold a contractor‑applicator permit, work for a permit holder, or get a contractor permit (license). A contractor permit costs $50 each year. Permits expire June 30. If you file renewal by June 30, your current permit stays valid through July 31 of the next permitting year or until the new permit is issued. If the Commissioner notifies you that you lacked a permit, you have 15 working days to get one without a late fee. After that grace period, you must pay a $50 late fee.
