Summary

Active Pharmaceutical Ingredient Manufacturing Grant Fund. Establishes the Active Pharmaceutical Ingredient Manufacturing Grant Fund to provide grant installment awards between July 1, 2026, and July 1, 2045, in an amount not to exceed $15 million per fiscal year and in an aggregate amount not to exceed $130 million, to a qualified company that (i) engages in the manufacture of pharmaceutical substances, (ii) executes a memorandum of understanding with the Commonwealth, and (iii) is expected to make a capital investment of at least $2,148,793,019 and create and maintain at least 468 new full-time jobs. This bill is identical to SB 404.

Drug ingredient factory grants with caps

The law creates a state grant fund for active pharmaceutical ingredient manufacturing. Total grants are capped at $130,000,000, with no more than $15,000,000 in any fiscal year. Payments can run for up to 20 years; any unpaid after 20 years are forfeited. Money may fund construction or any other lawful purpose. Payments can begin in the fiscal year starting July 1, 2026 and run through the one starting July 1, 2045, subject to annual appropriation. To get a yearly check, the company must file proof by October 1; missing the deadline defers payment. The Secretary certifies within 60 days, and checks are issued the next fiscal year if funds are appropriated.

Who qualifies for Goochland factory grant

To qualify, the company must make at least $2,148,793,019 in new capital investment. The investment must occur on or after July 1, 2025 and before July 1, 2045. It must create and keep at least 468 new full‑time jobs at the facility. Only a facility in Goochland County is eligible. A new full‑time job pays at least $113,632 a year and includes standard benefits. It must average 35 hours a week for 48 weeks, or 1,680 hours a year. Seasonal, temporary, and most contractor or vendor jobs do not count. This wage floor can rise under the performance agreement.

Grant agreement and document checks

The company must sign a performance agreement with the Commonwealth and VEDP. The agreement sets job and investment targets and how performance is checked. On request, the company must share documents that show it meets the rules. Documents the company marks as confidential are treated as proprietary under state law.
