Summary

Virginia Residential Landlord and Tenant Act; Eviction Diversion Program; eligibility. Requires any general district court that implements the Eviction Diversion Program to attach information about the Program, including eligibility criteria, to any summons for unlawful detainer. The bill also alters eligibility requirements for a tenant to participate in the Program. This bill is identical to SB 273.

Eviction case ends or moves fast

If you make every plan and current rent payment, the judge dismisses the eviction case. If you miss a plan payment or pay current rent more than five days late, the landlord can file a notice. The court then enters an order of possession without another hearing unless you file a sworn statement within 10 days saying you paid and were not credited. Your landlord can still file for non-rent violations while you are in the Program, and you both may sign a payment plan outside the Program. The landlord may also seek a money judgment for final rent and damages.

Court payment plan terms and deadlines

If you qualify, the court orders a payment plan and pauses the eviction case while you pay. After the 10% at court, pay 30% by the 5th of the next month, 30% by the 5th of the second month, and 30% by the 5th of the third month. Make plan payments to the landlord by cashier’s check, certified check, money order, or electronic transfer, received by the 5th. You must also keep paying current rent within five days of your lease due date each month.

How renters qualify for eviction diversion

To get into the Eviction Diversion Program, you must show up at the first court date and ask for it. Pay at least 10% of the amount due that day to the landlord or into the court. You must swear you have income or funds to make the plan and explain why you missed rent. You cannot join if you used a diversion program in the last 12 months, owe or defaulted on a rent payment plan in the last 12 months, or were late too often (over 2 times in 6 months or over 3 times in 12 months). Courts that run the Program must attach information and the rules to eviction summonses.
