Summary

Electric utilities and licensed suppliers of electricity; regional transmission entity; annual report. Requires each investor-owned utility or licensed supplier that joins or establishes the regional transmission entity (PJM Interconnection, LLC) to submit an annual report to the State Corporation Commission by February 1 of each year. Such report shall include (i) all recorded votes cast by the utility or licensed supplier at a meeting during the immediately preceding calendar year, (ii) all votes cast by an affiliate of the utility or licensed supplier at a meeting during the immediately preceding calendar year, and (iii) a brief description explaining how each recorded vote is in the public interest. The provisions of the bill do not apply to municipal utilities or certain electric cooperatives. This bill is identical to SB 777.

Municipal utilities exempt from PJM reporting

Municipal electric utilities and entities organized under Chapter 9.1 do not have to file the PJM voting report. Their affiliates and subsidiaries are also exempt. This exemption removes the filing and response duty for those local utilities.

Utilities must report PJM voting

The law requires each investor-owned electric utility or licensed supplier that participates in PJM to file a yearly report with the State Corporation Commission by February 1. The report lists every recorded vote the company cast at any PJM meeting in the prior calendar year, plus votes by its affiliates when the company did not vote. For each vote, the filer must add a 20- to 100-word explanation of why the vote is in the public interest. In Commission cases, regulators can also request information about these recorded votes.
