Summary

State Board of Local and Regional Jails; standards and regulations for pregnant and postpartum incarcerated persons in local and regional correctional facilities; report. Directs the State Board of Local and Regional Jails to set minimum standards and regulations regarding lactation policies for incarcerated persons and their infants by December 1, 2028. In developing such regulations and standards, the Board is directed to consider best practices related to lactation and how to incorporate such practices into the regulations and standards set by the Board.

Lactation support standards in local jails

The law requires the State Board of Local and Regional Jails to set minimum lactation standards for local and regional jails by December 1, 2028. When setting the rules, the Board must consider following medical advice during and after birth unless safety requires otherwise, offering lactation support after birth, and screening at intake for recent birth and lactation. It must also consider access to pumps and storage bags, a private place to pump, a freezer, safe milk storage, and, when possible, a way to provide milk to the infant. The Board must consider frequent in-person visits with infants, added nutrition for people who are nursing, and collecting and publicly reporting data to improve services. The Board must review research and may consult formerly incarcerated people, sheriffs, jail groups, doctors, doulas, advocates, and university experts.
