Summary

Selling, giving, or distributing a tianeptine product; civil penalty. Provides that a retail establishment that sells, gives, or distributes a tianeptine product, without a prescription, is subject to a civil penalty in the amount of $2,500 for a first violation and a civil penalty in the amount of $5,000 for a second or subsequent violation within a three-year period. The bill also provides that such provisions shall not preclude prosecution under any other statute.

Retailers fined for tianeptine without prescription

The law bans retail stores from selling, giving, or distributing any tianeptine product for human use without a prescription. A first violation is a $2,500 civil penalty. A second or later violation within three years is a $5,000 civil penalty. If an employee makes the sale, the store pays the penalty. Any law-enforcement officer may issue a summons, and a local Commonwealth's attorney can sue to collect the penalty; money goes to the state treasury. This does not block criminal charges under other laws.
