Summary

Decreasing probation period. Establishes criteria for which a defendant's supervised probation period shall be reduced, including completing educational activities, maintaining employment, completing treatment, or obtaining housing. The bill provides that a court may decrease a defendant's probation period if warranted by the defendant's conduct upon receipt of a request from the Department of Corrections and requires the Department of Corrections to request termination of a defendant's supervised probation period after 12 months in certain situations. This bill is identical to HB 149.

Hearing required to change probation

The court must give you and the Commonwealth’s attorney reasonable notice and hold a hearing before changing your probation terms or length.

Victims get notice when probation ends

The Department of Corrections must make reasonable efforts to notify the victim, as defined in §19.2-11.01(B), when supervised probation ends under this law.

Earlier end to probation for compliant people

Courts can shorten probation without a hearing when the Department of Corrections asks and your conduct warrants it. If you are on supervised probation longer than one year, after 12 months DOC must ask the court to end supervision if you met all court rules, followed your case plan, and pose minimal risk. This 12-month process does not apply to people with a mandatory supervised probation of at least three years under §19.2-303 or to people sentenced under §19.2-303.3 who are supervised by a local community-based probation agency. Courts still keep any other legal power to reduce or end probation.
