Summary

Maximum number of judges in each judicial district and circuit; study to examine organization and boundaries of certain judicial districts; report. Increases by one the maximum number of authorized general district court judges in the Twelfth and Twenty-sixth Judicial Districts. The bill also increases by one the maximum number of authorized juvenile and domestic relations district court judges in the Twelfth and Fifteenth Judicial Districts. The bill further increases by one the maximum number of authorized circuit court judges in the Twentieth and Twenty-seventh Judicial Circuits. Under the bill, the provisions relating to increasing the number of judges in the Fifteenth and Twentieth Judicial Circuits have a delayed effective date of July 1, 2027.Finally, the bill directs the Judicial Council of Virginia to study the organization and boundaries of the Fifteenth and Twentieth Judicial Circuits and to submit an executive summary and a report of its findings and recommendations to the Governor and the General Assembly no later than November 30, 2026.As introduced, this bill was a recommendation of the Committee on District Courts and the Judicial Council of Virginia. This bill incorporates SB 780.

Fixed caps on district and circuit judges

The law sets a hard cap on full-time judges in every Virginia court district and circuit. It lists the maximum number of General District and Juvenile and Domestic Relations judges for each judicial district. It also lists the maximum number of circuit judges for each judicial circuit. Each district and circuit can have no more than the number listed in the law.

New steps before adding circuit judges

No one can authorize a new circuit judge until the Judicial Council studies the need and reports to the House and Senate Courts of Justice. If the Council finds a need, it must share the study with the Compensation Board and those committees and publish a notice in a publication read by Virginia attorneys. After that finding, the Compensation Board must study courtroom security and deputy clerk staffing and send its report to those committees and the Department of Planning and Budget.

Study and delayed changes for two circuits

The Judicial Council must study how the Fifteenth and Twentieth Judicial Circuits are organized and where their borders should be. The study must review caseloads, population, past workload studies, court practices, travel time, and growth, and say whether boundary changes would help. The Council must finish meetings by November 30, 2026, and send a summary and full report to the Governor and General Assembly. Changes in this act that affect those two circuits take effect July 1, 2027.
