Patients can buy medicines from optometrists

Virginia allows TPA-certified optometrists to sell and dispense Schedule VI medicines directly to their own patients. The medicines must treat conditions of the eye or nearby structures, such as eyelids. Optometrists need authority to prescribe these medicines and a Board of Pharmacy license, which can be a limited-use license. They must be on-site, actively help dispense the medicine, and explain proper use. Only finished medicines in their original, unchanged form are allowed, with the manufacturer's labeling. Prescriptions must be for topical, eye, or oral use, and patients must take or apply the medicine outside the office. Optometrists cannot compound, repackage, or alter these medicines; their broader prescribing and treatment powers do not expand. State rules cover storage, packaging, labeling, records, and reporting, and dispensing sites are subject to inspection. Dispensing facilities need pharmacy board permits; sites with one licensed practitioner pay no permit application or renewal fees. The board also has limited-use licensing authority for specified medical practitioners at nonprofit facilities. The optometry and pharmacy boards can issue implementing rules, and initial rules can bypass the Administrative Process Act. The law sets no patient payment amount or insurance coverage change.
