Summary

Restaurants; food allergy awareness notice required. Requires the State Health Commissioner to publish in multiple languages a notice on the Department of Health's website containing procedures for restaurant staff to follow when a customer has a food allergy. The bill requires restaurants to post such notice in a conspicuous location. The bill also requires restaurants to include the phrase, "If you have a food allergy, please notify us," and its translation, if applicable, on their menus or on a sign posted conspicuously in the restaurant. This bill is identical to HB 373.

The Virginia Department of Health posts a standard food allergy notice online. It is in English and the top six non-English languages in the state. It includes the phrase "If you have a food allergy, please notify us." It explains what staff should do, how to avoid cross-contact, and when to call emergency medical services.

Restaurants must post allergy notices

Restaurants must follow new food allergy notice rules. You must post the state’s staff notice where kitchen and service workers can see it. Post it in at least one language each employee speaks, if the state provides that language. Put "If you have a food allergy, please notify us." on each menu or on a clear sign, and include any state translation if your menu is in that language. If you post a menu online, include the allergy notice and give customers a way to note their allergies.
