Summary

Virginia Residential Landlord and Tenant Act; Eviction Diversion Program; eligibility. Requires any general district court that implements the Eviction Diversion Program to attach information about the Program, including eligibility criteria, to any summons for unlawful detainer. The bill also alters eligibility requirements for a tenant to participate in the Program. This bill is identical to HB 837.

Who can enter eviction diversion

To enter the Program, you must appear at the first court date and ask for referral. You must pay at least 10% of the amount due that day to the landlord or into the court. You must give sworn testimony that you have income and enough money to make the plan, and explain why you fell behind. You are not eligible if you owe under a payment plan from the last 12 months, defaulted on a plan in the last 12 months, or took part in an eviction diversion program in the last 12 months.

Court payment plan to stop eviction

If you qualify, the court puts you and your landlord into the Program and orders a payment plan. The case is continued to give you time to pay. After your first payment at court, you must pay 30% of the amount due by the 5th day of each of the next three months. You must also keep paying your regular rent within five days of its normal due date. Plan payments must be made to the landlord by cashier’s check, certified check, money order, or electronic transfer, and received by the 5th. If you finish the plan, the judge dismisses the case. If you miss payments, the court enters an order of possession without another hearing unless you file an affidavit within 10 days saying the current rent was paid and not credited. Courts attach Program information to eviction summonses. Your landlord can still file for non‑rent lease violations, may seek a money judgment, and you both may sign a voluntary payment plan outside the Program.
