Summary

Constitutional amendment (voter referendum); marriage between two adult persons; repeal of same-sex marriage prohibition. Provides for a referendum at the November 3, 2026, general election to approve or reject an amendment that requires the equal treatment under the law of a lawful marriage between two adult persons regardless of the sex, gender, or race of such persons. The amendment also repeals the current provision that defines marriage as only a union between one man and one woman. This bill is identical to HB 612.

Equal marriage rights for adult couples

The law places this amendment on the November 2026 ballot. If a majority votes yes, starting January 1, 2027, Virginia repeals the ban on same‑sex marriage. Clerks cannot deny a marriage license to two adults because of sex, gender, or race. The state recognizes all lawful marriages between two adults and treats them equally, including marriages from other states.

No marriage-like status for unmarried couples

This amendment is on the November 2026 ballot. If a majority votes yes, starting January 1, 2027, Virginia and localities cannot create or recognize legal statuses for unmarried relationships that act like marriage. The state also cannot assign marriage rights or duties to any other union or partnership.
