Summary

Safeguarding American Veteran Empowerment Act; prohibited practices; penalties. Creates the Safeguarding American Veteran Empowerment Act to regulate the practices of persons seeking to receive compensation for preparing, presenting, prosecuting, advising, consulting, or assisting any individual regarding any veterans' benefits matter, as defined in the bill. The bill provides that a violation of its provisions constitutes a prohibited practice under the Virginia Consumer Protection Act. This bill is identical to HB 398.

Lower capped fees for veterans' claim help

Providers must give you a signed written contract before they work on your VA claim. You pay only if your benefits increase, and the fee can be no more than five times the monthly increase. They cannot charge any upfront or nonrefundable fee. If your award is later reversed, they must refund the fee (except when a reduction is due to improved functionality). For claims filed within one year after you leave active duty, no one may charge you unless you sign a waiver, and no one may be paid for referrals.

Stronger privacy for veterans' benefits data

Providers cannot use overseas call centers to handle your personal information. They cannot use your login, username, or password to access your VA, medical, or financial records. Before anyone sees your data, the provider must complete identity and criminal background checks.

Clear disclosures and no promised results

Agreements must include a clear notice that the business is not part of the U.S. Department of Veterans Affairs and that similar help may be free. The notice must be in at least 12-point font, signed by you, and kept for at least one year after services end. Providers cannot promise or guarantee a certain outcome on your claim.

Veterans' protections enforced under consumer law

Breaking these veterans' rules counts as a prohibited practice under the Virginia Consumer Protection Act. You can use the Act's enforcement tools and remedies against violators.

Who these veterans' rules cover and exempt

The law defines who and what is covered, including the meaning of 'compensation,' 'person,' and 'veterans' benefits matter.' VA-accredited agents and attorneys remain under federal VA oversight; this chapter does not change their duties or requirements.
