Counties can abandon some state roads

The law lets a county end public status for a secondary road, a railroad crossing, or a public landing. The county gives notice by posting at the courthouse at least 3 days before a court term, or posting in at least 3 places for 30 days, and it publishes the notice in at least two newspaper issues. It also notifies the State Board or Commissioner of Highways, and for landings the Department of Wildlife Resources; if the feature spans counties, all counties must agree first. Abutting owners, the Board, or (for landings) the Department can force a public hearing by filing a petition within 30 days; the county then publishes the hearing twice (first no more than 28 days before, second at least 7 days before) and notifies the Board or Department. If no petition is filed, the county must act within four months after the 30‑day posting period; after a hearing, it must act within four months if it finds no public necessity. Once it adopts a compliant ordinance, the road, crossing, or landing stops being public; if a public need remains, the county dismisses the request. A compliant ordinance is presumed justified in later challenges.

When a local road can close

The law sets tests for closing a section of a secondary road. A county may find it unnecessary only when all are true: it is in a residence district; the county’s population density exceeds 1,000 people per square mile; keeping it open threatens public safety and welfare; and good alternate routes are readily available. The county must also give due consideration to the road’s historic value.

Wildlife board must approve landing closures

A public landing cannot be closed unless the Board of Wildlife Resources approves it by resolution. This adds protection for public water access.
