Summary

Virginia Residential Landlord and Tenant Act; tenant remedies; early termination of rental agreement by military personnel. Removes the requirement that military personnel terminating a rental agreement due to identified permissible circumstances shall provide the landlord with a termination date that is no more than 60 days prior to the date of departure necessary to comply with the official orders or any supplemental instructions for interim training or duty prior to the transfer.

Military renters can end leases early

If you serve in the U.S. Armed Forces or are a National Guard member on full-time duty or a civil service technician, you can end your Virginia rental lease early. You qualify if you get permanent change-of-station orders; temporary duty orders over 3 months; a discharge or release from active or full-time Guard/technician status; orders to move into government housing that make you lose your housing allowance (BAQ/BAH); or a stop‑movement order tied to a local, national, or global emergency that is indefinite or lasts at least 30 days and keeps you from living in the unit. Give your landlord written notice with an end date. That date must be at least 30 days after the first rent due date that comes after you give notice, and no more than 60 days before your required departure or any interim training/duty in your orders. Before the end date, give the landlord your official orders or a signed letter from your commanding officer. If you follow these steps, the landlord cannot charge any liquidated damages.
