Summary

Zoning; manufactured housing. Amends existing provisions that require localities to permit manufactured homes in areas zoned for agriculture by expanding such requirement to all zoning districts where site-built housing is allowed, with certain conditions. The bill provides that localities shall not adopt or enforce any zoning, land-use, or development regulation that treats manufactured homes differently or more restrictively than a single-family site-built dwelling allowed in the same zoning district. The bill also removes the authority of localities without a zoning ordinance to designate the areas within the locality in which manufactured homes may be located. This bill is identical to HB 655.

Same zoning rules for manufactured homes

In farm-focused zoning districts where site-built homes are allowed, manufactured homes are allowed. In other similar districts, you can place a manufactured home on an individual lot if it is on a permanent foundation, is converted to real property under § 46.2-653.1, and has a certificate of occupancy issued within five years of the manufacture date on the home's data plate. Localities must use the same development standards as for site-built single-family homes and cannot be more restrictive. Local rules can set uniform standards for all houses in a district, but they cannot exclude manufactured homes that meet Virginia’s construction and safety standards.

Localities can zone for manufactured homes

Any Virginia locality can adopt an ordinance that designates where manufactured homes and manufactured home parks may go, even without a zoning ordinance. Local rules may use state provisions in §§ 15.2-2241 through 15.2-2245 and may cover areas licensed as campgrounds under Title 35.1. If a local rule conflicts with state law, state law controls.

Private covenants can still block homes

Zoning that allows manufactured homes does not cancel private, recorded restrictive covenants. A recorded covenant on your property can still bar a manufactured home, even if local zoning allows it.
