Summary

Storage of firearms in a residence where a minor or person prohibited from possessing a firearm is present; penalty. Provides that any person who possesses a firearm in a residence where such person knows that a minor or a person who is prohibited by law from possessing a firearm is present shall store such firearm and the ammunition for such firearm in a locked container, compartment, or cabinet that is inaccessible to such minor or prohibited person. Under the bill, any person who violates this provision is guilty of a Class 4 misdemeanor. The bill also requires any dealer, as that term is defined in current law, to post a written notice informing the public of the penalty imposed for failure to comply with the bill's provisions.

Gun dealers must post safety notice

Every firearm dealer must post a clear notice in the store about the home storage rule and that violations are a Class 2 misdemeanor. The notice must use the wording required by state law and be easy to see at the premises.

Locked gun storage with minors or barred people

If you have a gun at home and know a minor (under 18) or someone barred from having guns is there, you must lock the gun or use a proper gun lock so it cannot fire. You may keep a gun loaded only in a lockbox with a combo, code, or biometric lock, and the minor or barred person cannot be an authorized user for that lock. Breaking this rule is a Class 2 misdemeanor. This rule does not apply when you are lawfully carrying the gun on your person or for antique firearms. You may still allow a minor to access a firearm if you follow Virginia’s separate law that permits certain minor access.
