Summary

Continuing care providers; quarterly meeting requirements. Amends the quarterly meeting requirements for continuing care facilities to provide that at least two of such meetings per year shall be open to all residents and that certain individuals shall participate in at least two of such meetings per year. The bill also requires, if requested by the resident council or a majority of the independent living residents of a continuing care facility, the provider to include as a participant in the meetings of its board of directors or other governing body a resident representative elected by a majority of such residents, who shall participate in a non-voting, advisory capacity. This bill is identical to HB 476.

Quarterly resident meetings with facility leaders

The governing board of each continuing care facility meets with residents or their elected reps at least once every quarter. Residents get at least seven days' notice for each meeting. At least two meetings each year are open to all residents and may cover finances, policies, and services. At least two meetings each year include in-person attendance by a board member who is not employed at the facility and the provider’s CEO or equivalent. At least one of those leadership meetings is open to all residents. If a designee attends instead of the board, they cannot be the executive director or an employee.

Resident representative joins board meetings

If the resident council or a majority of independent living residents ask, the provider must include an elected resident representative in board meetings. The representative serves as a non-voting advisor chosen by a majority of residents. The board can still hold private executive sessions when allowed by law.

Stronger rights for continuing care residents

Residents in Virginia continuing care facilities have the right to form and join a residents' organization. Providers cannot retaliate against any resident for joining, taking part, or filing a complaint. Providers must give the residents' organization copies of all documents they submit to the Commission.
