Summary

Active Pharmaceutical Ingredient Manufacturing Grant Fund. Establishes the Active Pharmaceutical Ingredient Manufacturing Grant Fund to provide grant installment awards between July 1, 2026, and July 1, 2045, in an amount not to exceed $15 million per fiscal year and in an aggregate amount not to exceed $130 million, to a qualified company that (i) engages in the manufacture of pharmaceutical substances, (ii) executes a memorandum of understanding with the Commonwealth, and (iii) is expected to make a capital investment of at least $2,148,793,019 and create and maintain at least 468 new full-time jobs. This bill is identical to HB 800.

Grants and payment rules for drug-ingredient makers

The law creates the Active Pharmaceutical Ingredient Manufacturing Grant Fund to pay grants to companies that make drug ingredients. Grants are available each fiscal year starting July 1, 2026 through the fiscal year that begins July 1, 2045, if program terms are met. Total grants are capped at $130 million, with no more than $15 million in any year. Payments are made in up to 20 yearly installments; any amount not earned by year 20 is forfeited. A company must file by October 1 each year with proof of last year’s new full-time jobs and capital investment; late filings defer payment. The Secretary certifies the amount within 60 days, and the State Treasurer pays in the next fiscal year, but only if the General Assembly appropriates the money. Grant money can be used to build and develop the facility or for any other lawful corporate purpose. Companies must provide records on request; properly labeled records are treated as confidential.

Who qualifies and what jobs count

To qualify, a company must make active pharmaceutical ingredients in Goochland County. It must invest at least $2.149 billion and create and keep at least 468 new full-time jobs. The investment and jobs must occur on or after July 1, 2025 and before July 1, 2045. A new full-time job is based at the facility, pays at least $113,632 a year, includes standard benefits, and works 35 hours a week for 48 weeks or 1,680 hours a year. Seasonal, temporary, and contractor or vendor roles do not count. The company must sign a memorandum of understanding with the Commonwealth and VEDP that sets the targets, any wage escalators, and how payments are calculated.
