Summary

Tow truck drivers; registration. Prohibits towing and recovery operators from employing tow truck drivers who are not registered with the Department of Criminal Justice Services, as required under current law. The bill also limits the requirement that a registered tow truck driver have his registration in his possession when driving a tow truck to when such driving is for hire.

Statewide registration for tow drivers

Starting January 1, 2013, you must register with the Department of Criminal Justice Services to drive a tow truck for hire. People with the old state authorization may use it only until it expires. You pay a nonrefundable $100 application fee plus the cost of fingerprinting and an FBI background check. Registration lasts up to 24 months; you must carry it while driving. The Department may issue a temporary registration while your application is pending. You cannot register if you are on the Sex Offender Registry, or if you were convicted within 15 years of a violent crime or a tow‑driving‑related crime; limited grandfathering applies to drivers who held a valid authorization on January 1, 2013 and have had no violent convictions since then. The Department can deny for older convictions and must deny if probation or parole is not finished. Registered drivers must report any new felony or misdemeanor within 10 days. Driving without registration is a Class 3 misdemeanor.

Stricter conduct rules for tow drivers

You must not use fraud, endanger the public, or drive while impaired. You may not tow a police‑requested vehicle to a location outside Virginia. You cannot let anyone ride in a vehicle while it is being towed. You also cannot solicit towing at a wreck or disabled‑vehicle scene. A first solicitation offense is a Class 3 misdemeanor; later offenses are Class 2 misdemeanors.

Pricing and payment rules for towing businesses

Towing businesses must keep a current driver list at the main office. They must post and give customers a clear fee schedule and keep itemized records for one year. They must accept personal checks and, unless they make under $10,000 a year from towing, accept credit cards as required. They must make up to $100 in change, allow owners to take personal items without a fee, give written notice about reimbursement rights for stolen vehicles, and not demand extra papers before releasing a car. They cannot employ unregistered drivers or people who must register as sex offenders, and may not let unregistered people ride in the tow truck during a tow.
