Summary

Collection and reporting of data related to adults charged with a criminal offense punishable by confinement in jail or a term of imprisonment; Virginia Longitudinal Data System. Allows the Virginia Criminal Sentencing Commission to contribute the statewide and locality-level data it collects on adults charged with criminal offenses punishable by incarceration to the Virginia Longitudinal Data System administered by the State Council of Higher Education for Virginia. The bill states that any data provided that contains any personal or case identifying information shall be kept confidential and shall not be subject to the Virginia Freedom of Information Act. This bill is identical to HB 1084.

Public justice data and annual report

By December 1 each year, the Commission sends a report to the General Assembly, the Governor, and the Supreme Court’s Executive Secretary. It also posts a downloadable, de-identified dataset and an interactive dashboard with aggregated results. Personal and case-identifying information is not public and is not subject to the Virginia Freedom of Information Act, and the agency does not have to create formats it does not use. The Commission may share identifying data with the Virginia Longitudinal Data System only to link records and build de-identified research files; those identifiers remain confidential and are not released.

Statewide tracking of adult criminal cases

The Virginia Criminal Sentencing Commission must collect, each year, statewide and local data on every adult charged with a jailable offense. State agencies and circuit court clerks must share data they maintain, and the Supreme Court’s Executive Secretary must transfer circuit court case data on request. The dataset includes demographics, charges, prior cases, supervision, detention and bail terms, failures to appear, outcomes, sentences, and representation. The Commission uses these data only for research, evaluation, or statistics and must keep identifying information confidential and secure. Agencies do not have to provide data they do not keep or that law or the Virginia Rules of Professional Conduct forbid sharing.
