Employer tax funds uninsured claims

The law adds a tax, up to 0.5%, collected the same way as other workers’ comp taxes in Chapter 10. It is in addition to the Administrative Fund and Second Injury Fund taxes. The Comptroller holds this money in the Uninsured Employer’s Fund to pay awards against uninsured or self-insured employers and to cover allowed administrative costs. If the Fund’s year-end balance is higher than next year’s budgeted expenses, the tax is suspended for the next calendar year.

Fund pays its own admin costs

The Uninsured Employer’s Fund pays its own program costs. This includes administrator fees, legal fees, medical audit fees, and staff pay and benefits. Money used for these costs cannot be recovered from employers under the Fund’s recoupment rules.
