Summary

Parking, stopping, and standing enforcement; bus obstruction monitoring systems. Allows localities to authorize the use of bus obstruction monitoring systems by a public transit agency operating within the locality for the purpose of enforcing local ordinances related to parking, stopping, or standing in bus stop zones or in lanes reserved for transit buses during posted times. This bill is identical to HB 564.

Privacy limits for bus cameras

The system must capture and analyze images on the bus, and only likely violations may be sent off the bus. Images that show a violation can be kept up to six months, or 60 days after the case ends, then must be deleted. Images cannot be used for other police work, but can check bus stops, shelters, and signs. The law bans facial recognition and other biometric ID in these systems. Vendors can supply the cameras, but they must be paid for goods and services, not per ticket or fine.

Bus-lane camera tickets and safeguards

Localities can let transit agencies use bus-mounted cameras to ticket cars blocking bus stops or bus-only lanes during posted times. A locality must pass an ordinance and sign an agreement to send images to the right official. Tickets based on these images may be mailed and must state the evidence came from the system. You get at least 30 business days from the mailing to inspect the photos or video. For the first 60 days after a locality starts the system, only warnings are issued. If you miss the return date on a mailed summons, you cannot be arrested or held in contempt for that alone.
