Became Law

Summary

Department of Taxation; free tax filing program for individuals. Directs the Tax Commissioner to develop and offer a free individual state income tax filing program, effective beginning in taxable year 2028, that is similar to the federal Internal Revenue Service (IRS) Direct File Program as it existed during the 2025 tax filing season. The bill contains technical amendments that remove obsolete language regarding fillable forms. This bill is identical to HB 1180.

Fillable Virginia tax forms online

The Department of Taxation posts all required Virginia tax forms as fillable PDF files on its website. It also publishes guidelines for how to use these forms. This applies to tax years beginning January 1, 2012 and later.

Free Virginia tax e-file in 2028

The law creates a free, state-run online tax filing service for Virginia individuals. It is available for tax years that begin on or after January 1, 2028. The Tax Commissioner must check security, consider the IRS Direct File 2025 source code, consult other states, and keep it compatible with any federal free e-file system. Eligibility must be less strict than the IRS Direct File rules from 2025. The law also repeals the earlier Virginia Free File statute, removing that program’s legal authority.
