Summary

Nonjudicial disciplinary proceedings in the Virginia National Guard. Removes the restriction on nonjudicial disciplinary proceedings that prevents reduction in rank for members with more than 10 years of service who are in the rank of E-5 or above.

Limits and appeals in Guard discipline

Commanders cannot give correctional custody, arrest in quarters, restriction, or extra duties as nonjudicial punishment. If you have more than 10 years of service and are E-5 or higher, your rank cannot be cut by NJP. You keep all appeal rights under the Manual for Courts-Martial. Appeals include review for abuse of discretion and for legal sufficiency of the evidence.

Guard now face state nonjudicial punishment

Virginia National Guard members not in federal service are subject to nonjudicial punishment under Part V of the Manual for Courts-Martial. If a major or higher imposes this punishment, you cannot demand a court-martial instead. These rules apply when you are serving under state authority.
