Summary

Virginia Self-Service Storage Act; disposal of abandoned personal property in certain cases; definitions. Creates a process by which the owner of a self-service storage facility may dispose of the personal property of an occupant of a leased storage space when such personal property has been left in such leased storage space or on the property of the self-service storage facility following the termination or nonrenewal of a rental agreement, provided that such noncompliance did not involve a failure to meet any financial or monetary obligation. The bill also clarifies that an occupant's last known address may be updated pursuant to a specific method as may be required by the terms of the rental agreement.

Storage renters: deadlines to reclaim items

When your storage lease ends and you leave items, the owner must send written notice to your last known address. The notice gives you 10 days to remove your things. The owner can dispose of them 24 hours after those 10 days end. You may access and remove items at reasonable times before disposal. Until disposal, the owner is not liable for loss. If items are sold, the money first pays what you owe and reasonable costs. Any extra cash goes to you.

Who counts, and nonpayment is different

The law defines key terms for self-storage, like owner, occupant, leased space, personal property, and verified mail. These meanings guide how notices, access, and disposal work. It also says the abandoned-property process here does not apply when the default is for unpaid rent or other money owed. In nonpayment cases, owners must use other legal remedies, such as those in §§ 55.1-2901 and 55.1-2902.
