Summary

Motor vehicle insurance; use of certain factors to establish rates prohibited. Prohibits an insurer from refusing to insure, refusing to continue to insure, or limiting the amount or extent of motor vehicle insurance coverage, or charge an individual a different rate for the same motor vehicle insurance coverage, solely because of such individual's consumer credit information or credit-based insurance score. The bill also directs the State Corporation Commission's Bureau of Insurance to study the use by insurers of an insured's or applicant's consumer credit information or credit-based insurance score in connection with underwriting motor vehicle insurance polices and to submit a report of its findings and recommendations by October 1, 2027.

Auto insurers can't use credit alone

Auto insurers cannot deny, drop, limit, or charge different rates solely because of your credit information or a credit-based insurance score. The Bureau of Insurance studies how credit is used in auto insurance and reports findings and recommendations by October 1, 2027, with help from the DMV.

Fair pricing for life and health insurance

The law prohibits insurers from unfairly charging different prices or benefits for the same risk. Life insurers must treat people with the same life expectancy the same in rates, dividends, and terms. Accident and health insurers must treat people with the same hazard the same in premiums, fees, benefits, and terms.

Insurance can't penalize disability, donors, survivors

Insurers cannot refuse, limit, or charge more just because you are blind or have impairments, unless backed by sound actuarial data. They cannot penalize you for being a living organ donor when donor status alone is the reason. They also cannot use your status as a domestic violence victim to set prices, renewals, coverage scope, or claim payments, except for some legal services plans and listed insurance classes. Insurers may still ask about medical conditions and use medical information where other law allows.

Extra health coverage allowed, group pays first

Insurers cannot refuse to issue or renew an individual accident or sickness policy that provides benefits above a group plan’s lifetime limit. When both individual and group coverage apply, the group policy pays first up to its coverage. This helps workers add extra protection and know which plan pays first.

No home insurance denials for age or area

Insurers cannot refuse, cancel, nonrenew, or limit home or personal property coverage only because a home is old. They also cannot take those actions only because of where you live or where the risk is. Insurers may act when a real business reason exists that is not a pretext, or when law or regulators require it.
