Summary

Unauthorized use of voice or likeness; punitive damages; statute of limitations. Expands the existing ability for any person to maintain a suit in equity, including the accompanying remedies available and statute of limitations, for the unauthorized use of his name, portrait, or picture for advertising purposes or for the purposes of trade to include the unauthorized use of his voice or likeness. This bill is identical to HB 581.

Right to control your name and likeness

The law bans using your name, photo, voice, or likeness in ads or for trade without written consent. You can sue to stop the use and get money for harm. A jury can award punitive damages if the misuse was knowing. For minors, a parent or guardian must give written consent. For a deceased person, consent must come from the surviving spouse or, if none, the next of kin.

20-year limit after death to sue

Families have 20 years from the date of death to start a case under this law. After 20 years, no lawsuit can be filed over the person’s name, photo, voice, or likeness.
