Vermont buyers get flood details from sellers

Beginning September 1, 2025, Vermont property sellers must give buyers flood information before or as part of the sale contract. Sellers must provide a paper or electronic copy, or digital link, to the community’s official FEMA flood insurance rate map. If no map is available, sellers must tell buyers. Sellers must report flooding or flood damage while they held the property, including flood-related erosion or landslide damage. They must also disclose whether they carry flood insurance or federal or state law requires them to carry it. Missing required information lets buyers cancel before taking title or occupying the property, whichever comes first. Buyers can sue for damages and reasonable attorney’s fees, and seek punitive damages for a seller’s knowing failure to disclose. Sellers may be excused from liability for errors, inaccuracies, or omissions based on public-body information or licensed professionals’ written reports they reasonably believed were correct. Failure to disclose does not affect the marketability of the property’s title.
